JOB TITLE: CONTRACTS ENGINEER

 

KEY RESPONSIBILITIES:

  • The Contracts Engineer will undertake all necessary contract, commercial and subcontracting activities to support both business capture and subcontracts/ partnership engagement with regards to pre-ITT, ITT and post award activities.
  • In a busy, fast growing and stimulating business the Contracts Engineer , in support of the Senior Commercial Manager, is required to work on own initiative dealing directly with business stakeholders to support key commercial, contractual and subcontracting activities and requirements in line with Petrofac policies and procedures.
  • Support the development of commercial and contractual responses to client enquires and proposal requests from clients in support to the ETP team including:
  • Working with technical team to develop commercial responses as required
  • Coordinating input from all Petrofac stake holders including, Compliance, Legal, Finance, Tax, and security etc as required
  • Qualify client T&C’s / Heads of Terms if provided in line with Petrofac procedures
  • Coordinate and support the Senior Commercial Manager in  obtaining approval via the Petrofac Risk Review Process as required, i.e.
  • Kick off risk review process.
  • Coordinate and manage submissions and review meetings as required by the process.
  • Close out actions as required.
  • Oversee, negotiate and finalise agreements for ETP as agreed via the RRC process, ensuring compliance with required protocols and stakeholder guidance such as Legal, Tax, HSSEIA, and Technical etc.
  • Review and negotiate Confidentiality and non-disclosure agreements associated with ETP and BD activities.
  • Under the supervision of the Senior Commercial Manager develop and negotiate MoU’s and Collaboration agreements with key partners to support growth of the Business.
  • Work with the commercial and operational management team to ensure that service delivery is compliant with contractual terms.
  • Proactively monitor each client contract to ensure critical dates such as rate reviews, renewals, extensions, work orders etc are in place.
  • Coordinate and manage response to any client contract disputes.
  • Guided by the Subcontracts Functional Head, lead the engagement with potential Construction subcontractors and the negotiation of commercial/contractual agreements with Technology Providers/ Licensors
  • Ensure that main contract  risks are appropriately mitigated through the relevant subcontracts and licensor agreements.
  • Contribute in bringing new and innovative commercial and sub-contracting structures / arrangements though internal process and subsequently to the market.
  • Proactively work with other Petrofac service lines to develop differentiated commercial offerings that maximise value to client and Petrofac.
  • ERP – assisting with uploading of contract/project information into ERP.
  • Assistance to Finance Department in invoicing clients and payments to Consultants/Subcontractors.
  • Assistance in maintaining and updating Standard contracts and model clauses database.
  • Maintaining effective communication and building strong relationships with internal departments.
  • Supports and manages all activities related to administration of contracts including risk identification, risk mitigation and risk management during the post award stage.
  • Initiation and preparation of variations and claims to Client. Assist in defending, negotiating and resolving claims with Client. Assist commercial team members in compiling supporting documents for potential claims, preparing advance defence for issues that are likely to evolve during execution phase.
  • Assist, Commercial Manager on contractual conflicts and claims with clients. In the event of a dispute, advise on the company’s position, information required in defense of or in pursuance of such.
  • To review on a regular basis, company’s position after evaluating reports received from the project team in respect of discrepancies, anomalies, risk and opportunities and take necessary action.
  • Assist in managing all activities related to contractual, legal, tax, commercial and insurance issues related to company business, contracts with clients and partnering agreements during the post award stage.
  • Assist in ensuring that the key contract terms and conditions are presented and understood by the Project Management and Commercial Team upon award of the Contract and also ensure that a proper handover takes place from the pre award team.
  • Responsible in ensuring implementation and adherence to HSE and Quality System Procedures during the post award stage.
  • Attend/support internal and external audits as required.
  • Responsible to assist in the development and monitoring relevant Commercial KPI’s.
  • Any other duty as directed by the Senior Commercial Manager.

 

ESSENTIAL QUALIFICATIONS AND SKILLS:

  • Solid working knowledge - including the ability to work with and modify special conditions.
  • Working knowledge of various remuneration models and renewable energy sectors.
  • Ability to deal with contractual qualifications efficiently and effectively
  • Experience in drafting / working with contracts with client and suppliers in differing commercial and contractual arrangements
  • Demonstrable ability to apply innovative solutions
  • Have knowledge of the UK Energy market.
  • Degree in Law, Law & Management or Quantity Surveying preferred but not essential dependent on the experience of the candidate
  • Self-motivated with a strong ability to work proactively and independently against tight deadlines
  • Team player with an open but strong working ethic
  • Excellent communication and presentation skills
  • Ability to prioritise and manage multiple work scopes in a busy environment
  • Proven negotiations skills
  • Ability to influence stakeholders and work successfully with technical disciplines to deliver strong results
  • Few years of experience in a similar role in Construction and/or Renewables sector.
